I went looking for an exact copy of Title IX on the web and couldn't find
one. :(
Title IX (written in 1972) states that at schools receiving federal
funding, student activities can not descriminate by gender among the
students at the school (There is a specific exemption for Social
Fraternities and Sororities). Since having students pay for college using
federal grants like Pell grants is considered Federal funding to the
school, this applies to almost all schools.
As I understand it, APO is not what is compliant, the schools are
compliant. If a school has a chapter of APO that is all-male than a Title
IX suit can be brought against the school suing for equality in this area
of student activities. The judge would have to decide if equal opportunity
in this area existed for women and if it didn't it would rule against the
school. Then the school would then presumably give the chapter the option
of either going co-ed or being derecognized.
This is my understanding, I'd think an exact understanding should be
gotten from Nationals and they would get it from the National Legal Counsel.
