Making the copyright be an include file is not necessary -- having a copyright notice in the code protects it. The include file only contains the "licensing" provisions that MIT will allow copying under. Putting it in an include file is just a convenience, and an easy way of ensuring that somebody who copies it gets the copying provisions.
