podesta spoke at length about the need to update law
enforcement policies to work in the cyber age.
highlights are raising the legal standard for
intercepting emails and communications sent via cable
modems to those existing for telephones. goal of
harmonization of the laws. trace and trap laws
addressed - proposal allows for law enforcement to
obtain only one order to t&t via several carriers.
same legal standards apply in terms of obtaining
judicial clearance as with telephones. a strengthening
of hacker laws - details in story. an increase in
penalties for wiretapping abuses. "illegally
interceptted communications could be used in court,
but only to prove the guilt or innocence of a person
accused of illegal wiretapping activity."
