That might not be easy, but I bet getting them to believe an
expert witness (who could say in no uncertain terms that neither
decryption was more probable than the other) would be much
easier.
I don't have my copy of Kahn handy -- he describes the situation --
but this isn't a new issue. Elizabeth Friedman cryptanalyzed the
traffic used by the rum runners during Prohibition; she was often
challenged on the accuracy of her decryptions by defense attorneys.
