ill is correct in that the 1977 Winter T&T has a reference to
this issue;
I disagree (and, and such, did not respond to his original post, although
I did read it) with his assessment.

Bill took a subsection of the entire proceedings regarding Title IX, but
for your pleasure (or boredom), here is the entire text of that section.
You should decide based on all of the information available; we're doing
our best to get the facts to you.  Unfortunately, the "facts" aren't facts
for everybody; this is apparent in any court case.  Anyway, I'd like to
thank Bill for his continued participation in this.  Any typos are mine,
folks.  By the way:  we were denied exemption from Title IX, even though
we tried to gain exemption specificaly.  We are still bound by Title IX.

TITLE IX

The delegates overwhelmingly passed resolutions reiterating the right of
each chapter to determine its own membership.  The Convention endorsed the
continuation of efforts to seek exemption from Title IX.  The specific
resolutions are as follows:

(1)  Nothing in these By-Laws is intended in any way to permit any chapter
to be in violation of laws respecting the civil rights of any persons.

(2)  In all cases where a change is to be made, the Style Committee is
advised to make a change to the neuter gender, such as persons, students,
members or individuals, in lieu of changing so as to use both male and
female genders, such as replacing "men" with "men and women."

(3)  The National Office, in coopration with the National Board of
Directors, seek relief through the courts from efforts to comlem the
Fraternity to comply with the (membership) provision of Title IX of the
Educational Amendments of 1972; the 1976 National Convention urges the
National Office and local chapters to enlist the support of actie
Brothers, alumni,similar groups and interested parties to promote further
legislative and/or judicial action with reference to Section 901 (A) of
the Education Amendments of 1972 to assure service fraternities access to
or relief similiar to the exemption provided in Public Law 93-568, Section
3(a) (6)(a), and that a nationwide letter-writing campaign be undertaken
to secure legislative support for the enactment of such;
The National president appoint a task force of distinguished alumni and
other distinguished Americans to organize said campaign and encourage
further support for that effort; The National Board of Directors pursue
judicial approval to preserve the chapter option to determine its own
membership patterns; and All other avenues of appeal as may be
recommended by the Board.

(4) The Fraternity here assembled highly commends the National Board of
Directors and especially Brother Lorin A. Jurvis for their outstanding
efforts pursuant to securing an exemption from Title IX and urges
continued diligence in this regard.

(5) Chapters of Alpha Phi Omega will voluntarily transmit funds to the
National Fraternity for the express purpose of financing efforts to secure
exemption from Title IX.

(6)  Nothing in the National By-Laws or Articles of Incorporation shall be
construed to require any chapter to accept any student as a pledge or
active member of its chapter.

(7) All chapters, undergraduates and alumni and all officers of Alpha Phi
Omega join in a concerted effort of writing letters to their congressmen
and specifically to the Department of Health, Education and Welfare
regarding Title IX and specifically the reference to making Alpha Phi
Omega, which is a Service Fraternity, exempt from the provisions of Title
IX.  (Copies of such letters should be forwarded to the National Executive
Director as a matter of record.)

(8)  "The Report on the Options for Exemptions from Title IX" be further
researched and acted upon.

(9)  Competent legal counsel be engaged to carry the request for exemption
from Title IX to HEW.

(10)  A National Task Force on Exemption be established, composed of
volunteer members.  The Task Force shall include a steering comittee
composed of members from each of the ten regions, with significant
representation from the all-male chapters.  The purpose of the Task Force
shall be to provide continuous communication and coordiante efforts among
the chapters, Sectional Officers, the National Board and the National
Office of the Fraternity to facilitate and encourage successful pursuit of
Title IX exemption.
