I should point out that there is in Ohio a complex set of laws in regards
to alcohol. Putting aside for a moment the Faternity policy issues. Any
situation in which the organization condones, promotes, or assists the
commission of a violation of law is bad for the organization. Note that
Ohio Revised Code Section 4301.69 for example makes it a crime in most
situations to furnish "beer or intoxicaqting liquor" to any person under
21. This statute applies even to "private parties" Furnish is rather
broadly defined.
From a civil liability stand point violation of a criminal law is not the
best starting place.
